By accessing or using the Pet Symptom Check platform, website, or mobile applications ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service, including the web platform at https://petheal.app/, iOS mobile application, and Android mobile application.

2. DESCRIPTION OF SERVICE

Web Platform Services

• AI-powered pet symptom analysis and health condition assessment
• Educational pet health information and guidance
• Information about when to seek veterinary care
• Pet health resources and recommendations

Mobile Application Services

• Comprehensive pet health profile management
• Multi-pet support with individual profiles for each pet
• Secure storage of pet medical history, allergies, and medications
• AI-powered symptom tracking and health monitoring
• Lab result analysis (PDF and image upload)
• Personalized pet health notifications
• Offline access to pet profiles and previous assessments
• Chat history with AI health assistant

What We Do NOT Provide

• Veterinary diagnosis or treatment
• Emergency veterinary services
• Prescription medications or veterinary medical devices
• Professional veterinary advice or consultations
• Replacement for in-person veterinary examination

3. VETERINARY DISCLAIMER & LIMITATIONS

Critical Understanding Required

• Our AI provides informational guidance only, not veterinary advice
• Results should be discussed with qualified veterinary professionals
• The service cannot detect all pet medical conditions or emergencies
• AI analysis may not be suitable for all veterinary situations
• Always seek immediate veterinary attention for serious or urgent symptoms
• Different pet species may have varying symptom presentations

Scope of AI Analysis

Our AI system analyzes patterns in pet symptoms and provides educational information about potential conditions. The confidence levels and recommendations are based on algorithmic analysis and should not be interpreted as definitive veterinary conclusions.

Species Limitations

Our service primarily supports common companion animals (dogs, cats). Analysis for other species (birds, reptiles, small mammals, etc.) may have reduced accuracy and should be used with additional caution.

4. USER RESPONSIBILITIES

Accurate Information

• Provide truthful and accurate symptom information about your pet
• Update information if your pet's condition changes
• Do not submit false or misleading pet health data
• Accurately identify your pet's species, breed, and age

Appropriate Use

• Use the service for personal pet health information only
• Do not attempt to diagnose other people's pets or provide veterinary advice
• Follow up with veterinary professionals as recommended
• Understand the limitations of AI-based pet health assessment

Prohibited Activities

• Using the service for commercial purposes without authorization
• Attempting to reverse engineer or duplicate our AI technology
• Submitting spam, malicious content, or inappropriate material
• Creating false accounts or impersonating veterinary providers
• Attempting to manipulate AI recommendations or system responses
• Using the mobile apps in ways that violate App Store or Google Play policies
• Violating any applicable laws or regulations

Mobile App Specific Responsibilities

• Keep your app updated to receive important security and feature updates
• Maintain the security of your device and account credentials
• Use device permissions (camera, photos) responsibly for lab analysis features
• Report any app malfunctions or security concerns immediately
• Understand that data syncing requires active internet connection

5. PRIVACY & DATA PROTECTION

Your privacy is crucial to us. Our collection, use, and protection of your personal information and pet health data is governed by our Privacy Policy, which is incorporated into these Terms by reference.

We maintain strict security standards for all pet health information processing and ensure appropriate safeguards for your data.

6. INTELLECTUAL PROPERTY

Our Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Pet Symptom Check and its licensors. The Service is protected by copyright, trademark, and other laws.

Your License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes, subject to these Terms.

User Content

You retain ownership of the pet health information you provide. By using our Service, you grant us a limited license to process this information to provide our services, as described in our Privacy Policy.

7. SERVICE AVAILABILITY & MODIFICATIONS

Service Availability

• We strive for high availability but cannot guarantee uninterrupted service
• Maintenance windows may temporarily affect service access
• Emergency situations may require immediate service modifications

Right to Modify

We reserve the right to modify or discontinue the Service at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

8. AI SYSTEM TERMS & USER RIGHTS

AI System Transparency (EU AI Act Compliance)

• AI Model Information: Our system uses AI models to analyze pet symptoms and provide health guidance
• Human Oversight: All AI recommendations are informational and should be verified by veterinary professionals
• Accuracy Limitations: AI recommendations have varying confidence levels (displayed with each result) and should not replace professional veterinary judgment
• Bias Mitigation: Our systems undergo regular testing for accuracy across different pet species and breeds

Your Rights Regarding AI Decisions

• Right to Explanation: Request detailed explanations of how AI recommendations were generated
• Right to Human Review: Request human oversight of any AI-generated pet health recommendations
• Right to Challenge: Contest AI recommendations and request alternative analysis
• Right to Opt Out: Choose to receive general pet health information instead of personalized AI analysis

9. EU CONSUMER RIGHTS & WITHDRAWAL

14-Day Withdrawal Right (EU Consumers)

EU consumers have a 14-day right of withdrawal from digital service contracts. You can withdraw from using our service within 14 days of first use without giving any reason. Contact support@petheal.app to exercise this right.

Additional EU Consumer Protections

• Unfair Terms Protection: Unfair contract terms are void under EU consumer law
• Digital Content Rights: Right to conformity, updates, and remedy for digital service defects
• Alternative Dispute Resolution: Access to EU online dispute resolution platform
• Consumer Guarantee: Legal guarantee for digital services under EU consumer protection law

10. SUBSCRIPTION & IN-APP PURCHASES

Premium Features

Certain features of our Service may require a paid subscription. Subscription terms, pricing, and features are displayed within the app and on our website.

Payment Processing

• iOS: Payments are processed through Apple App Store
• Android: Payments are processed through Google Play Store
• All payments are subject to the respective platform's terms and conditions

Subscription Management

• You can manage your subscription through your device's app store settings
• Cancellation takes effect at the end of the current billing period
• No refunds for partial subscription periods unless required by law

Free Trial

If offered, free trial terms will be clearly displayed before subscription. Your payment method may be charged automatically when the trial ends unless cancelled.

11. DISCLAIMERS & LIABILITY (EU LAW COMPATIBLE)

SERVICE DISCLAIMERS (Subject to EU Consumer Law)

The service is provided with reasonable skill and care. To the extent permitted by law, we disclaim warranties for non-essential features. EU consumers retain all statutory rights under consumer protection law.

Limitation of Liability (EU Law Compliant)

Our liability is limited as follows, subject to EU consumer protection laws:

• Unlimited Liability: Death, personal injury, or damages caused by gross negligence
• EU Consumer Rights: We cannot limit liability for breach of consumer guarantees under EU law
• Limited Liability: For other damages, liability is limited to typical and foreseeable damages
• Veterinary Decisions: We are not liable for veterinary decisions made based on AI recommendations
• Pet Health Outcomes: We are not responsible for any pet health outcomes resulting from use of the Service

Maximum Liability Cap

For damages not covered by unlimited liability, our total liability shall not exceed EUR 10,000 or the amount you paid us in the twelve months preceding the claim, whichever is higher.

12. USER RESPONSIBILITY & PLATFORM COMPLIANCE

Subject to EU consumer protection laws, you agree to use the Service responsibly and may be liable for damages arising from intentional misuse or violation of these Terms:

• Intentional misuse of the Service for harmful purposes
• Deliberate submission of false pet health information
• Violations of third-party intellectual property rights
• Content that violates applicable laws

Note: EU consumers cannot be held liable for damages that are typical consequences of normal use or result from defects in our Service.

13. TERMINATION & DATA RETENTION

Termination by You

You may terminate your use of the Service at any time by ceasing to use the platform and, if applicable, deleting your account through the app settings.

Termination by Us

We may terminate or suspend your access to the Service immediately, without prior notice, if you breach these Terms or engage in prohibited activities.

Effect of Termination

Upon termination, your right to use the Service will cease immediately. Data retention and deletion will be handled according to our Privacy Policy.

Guest Mode

Guest mode users can convert to registered accounts at any time. Guest data is associated with device identifiers and may be subject to periodic cleanup.

14. GOVERNING LAW & DISPUTE RESOLUTION

Governing Law

These Terms are governed by German law and EU regulations. For EU consumers, mandatory consumer protection provisions of your country of residence may also apply.

Dispute Resolution

• EU Consumers: Disputes will be resolved in the courts of your habitual residence or Germany. You can also use the EU Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr/
• Business Users: Disputes will be resolved in the courts of Kiel, Germany, or through mediation as mutually agreed.

German Regulatory Authority

We are supervised by the relevant German authorities. For complaints about our AI systems, contact the German Federal Office for Information Security (BSI) or your local consumer protection authority.

15. GENERAL PROVISIONS

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Pet Symptom Check regarding the Service.

Updates to Terms

We reserve the right to update these Terms at any time. We will notify users of material changes via email or through the Service. Continued use constitutes acceptance of updated Terms.
